12-quater. SMTP Senpai free plan
Scope and activation. The SMTP Senpai free plan lets Customers send emails from their own applications and websites through MailSenpai's delivery service at no charge. It has no expiry date and requires neither a payment card nor billing details. Customers can create an account by choosing a password; before sending, they must confirm their account email address and verify a sending domain they control and whose DNS records they can change. For the free plan, this article takes precedence over conflicting provisions in articles 4, 10 and 12-ter.
12-quater.1 Limits. The free plan includes up to 5,000 emails per month, 200 per day, 30 per hour and one sending domain. The month and day are calendar periods in Italian time; the hourly limit applies to the preceding 60 minutes. Each email accepted for delivery counts once per recipient. When a limit is reached, the service rejects further emails until the next period. Hourly and daily limits produce a temporary error; the monthly limit produces a permanent rejection of that individual submission. The account remains active: the Customer's application can submit emails again when capacity becomes available. Emails that are not accepted are neither stored nor resent by MailSenpai. MailSenpai may change the free plan's limits by giving Customers at least 30 days' notice at their account email address.
12-quater.2 One account per domain. Each sending domain may be linked to only one free account. Opening multiple free accounts to circumvent the limits is not permitted.
12-quater.3 Shared IP address. Free plan emails are sent from an IP address shared by free accounts and separate from paid plans' IP addresses. Delivery also depends on other users' behaviour on that address and the recipients' email providers' rules.
12-quater.4 Service levels. The free plan is provided as is. Service levels, recovery times and compensation that may be available on paid plans do not apply. MailSenpai makes no commitment regarding service continuity or email delivery times and outcomes. This does not exclude or limit liability where the law does not permit such exclusion or limitation.
12-quater.5 Support and logs. Support is provided through documentation and support tickets. Telephone support, priority support and delivery consulting are reserved for paid plans that include them. Detailed sending logs are available in the Customer area and through the API for 7 days.
12-quater.6 Acceptable use. The use rules in these Conditions apply, including article 5's rules on recipient consent and unsolicited email. Customers may send only from their verified domain.
12-quater.7 Inactivity. If an account sends no email for 180 consecutive days, or its sending domain is not verified within 30 days of account creation, MailSenpai may deactivate the account and remove its sending configuration. Before removal, MailSenpai gives notice at the account email address at least 30 days in advance, with reminders 7 days and 1 day before removal. Sending an email or signing in to the Customer area before the deadline stops removal for inactivity; an unverified domain must be verified. After removal, the Customer may open a new free account.
12-quater.8 Suspension for abuse. MailSenpai may suspend an account for violations of the use rules, abuse reports, abnormal rates of rejected emails or spam complaints, or attempts to circumvent the limits. Suspension is preceded by notice to the account email address stating the reason and allowing at least 48 hours to remedy it. MailSenpai may suspend without prior notice, notifying the Customer immediately afterwards, where the behaviour threatens other users' service, sending IP reputation or compliance with the law. If the violation is not remedied or recurs, MailSenpai may close the account.
12-quater.9 Moving to a paid plan. Customers may upgrade from their Customer area while keeping their domain and credentials. Billing details are requested at that point, and the selected plan's conditions, limits and prices then apply. At the end of a paid plan, the account does not move to the free plan: sending stops unless the plan is renewed. The same applies after a refund under article 12-bis.
12-quater.10 Changes and discontinuation. MailSenpai may change or discontinue the free offer by giving Customers using it at least 30 days' notice. Customers may close their free account at any time.
These provisions form part of the General Terms of Supply.
